Texas man charged with felony assault after fight outside Kearney entertainment center

KEARNEY, Neb. (KSNB) – A 19-year-old Texas man is facing a felony charge after a fight in Kearney over the weekend.

Jesus Leyva Jr. is charged with one count of felony first-degree assault following the incident at Big Apple Fun Center early Sunday morning.

According to the arrest affidavit, Kearney police were called to the business just before 1 a.m. Sunday for a report of a man lying on the ground bleeding from an assault with blood running down the sidewalk.

The suspect had left the area, with police finding him near Tractor Supply, while the victim had been located at a hotel on Second Avenue.

Police learned that Leyva and the victim worked together.

After reviewing security video, it appeared the two engaged in what police described as a mutual consent fight, according to the affidavit.

However, the video shows at one point the victim lying on the ground unconscious with Leyva continuing to punch him several more times, according to police.

Hospital officials told police the victim sustained multiple orbital fractures, nasal fracture, multiple lacerations and could need surgery once released.

Leyva was booked into the Buffalo County Jail, where his bond was set at 10 percent of $100,000. His next court date is Nov. 18.
