A judge has denied Taylor Frankie Paul’s ex-husband, Tate Paul, a temporary restraining order against her.
In her ruling, commissioner Kim Luhn wrote that Tate’s allegations were “based upon inadmissible hearsay, without any corroborating evidence,” adding that “many of the concerns, like the children not doing well in school and expressing sadness, will require ongoing attention not remedied with an emergency order changing custody.”
Tate, 34, who shares 8-year-old daughter Indy and 5-year-old son Ocean with the Secret Lives of Mormon Wives star, 32, filed for the restraining order in Utah court on June 30, per court docs previously obtained by PEOPLE. He also filed a petition to modify the terms of their divorce and custody agreement. The former couple was married from 2016 to 2022.
The commissioner also wrote in her July 1 ruling that, “contrary” to Tate’s claim that his “children are in immediate danger,” Taylor told the court that her ex-husband had left her with his kids during a week-long trip to Iceland in June.
Tate and Taylor’s court battle follows news of an ongoing police investigation into whether Taylor violated a protective order against the father of her third child, Dakota Mortensen, 33, with whom she shares 2-year-old son Ever. A police spokesperson previously confirmed to PEOPLE that they were investigating an alleged protective order violation involving Mortensen and Taylor reported on June 26.
News also broke on June 30 that Taylor had a temporary stay in a rehab facility. A source told PEOPLE that she “checked into a facility upon the recommendation of her doctor,” adding that the stay was “voluntary” and that she has since departed.
Taylor and Mortensen have been engaged in a contentious, high-profile legal battle after a pair of investigations were launched by Utah police departments in February into allegations that each acted violently during altercations that month.
Paul has accused Mortensen in court of stalking and, on one occasion, slamming her head into the dashboard of his truck. Mortensen has submitted photographs of scratches and other physical injuries he allegedly received during altercations with Paul.
As investigations were ongoing, Mortensen filed for a protective order against Paul, and she filed for a protective order of her own several weeks later. The orders were mutually granted for three years on April 30. A judge on June 1 granted Paul custody of Ever on the same midweek day each week without overnights, as well as alternating weekends.

Amid Taylor’s public dispute with Mortensen — as well as the public release of a 2023 video capturing a violent altercation between the pair and ABC calling off her already-filmed season of The Bachelorette — her relationship with Tate has grown more complicated.

On June 3, he wrote in the comments of a livestream hosted by Cru Eaton, Mortensen’s roommate, “My co-parenting relationship has been peaceful for the most part. “The last few months has been not so.”

A source close to Taylor told PEOPLE at the time that she and Tate “have always been a strong team,” adding, “The last few months have, of course, complicated their co-parenting dynamic, but they’re navigating it together. She’s committed to maintaining a strong relationship with him and tackling the challenges that have arisen.”
