Influencer Emilie Kiser<\/strong>\u2019s plea to redact details about son Trigg\u2019s tragic death was granted in an order by the judge.<\/p>\n

\u201cThis case requires a difficult balancing between two strong but competing interests: the strong right the public has in examining government records under Arizona\u2019s Public Records Law, and the profound privacy rights of a grieving mother,\u201d read the judge wrote in a letter obtained by Us Weekly<\/em> on Friday, August 8.<\/p>\n

Kiser, 26, did \u201cnot object\u201d to the release of the report. Instead, she requested to have \u201ctwo and a quarter pages and one sentence\u201d redacted as it contained \u201cgraphically detailed descriptions of the video capturing the final moments\u201d of her son\u2019s life.<\/p>\n

\u201cHowever, this right of access is not absolute,\u201d the letter continued. \u201cCourts recognize that privacy concerns can outweigh the public\u2019s right to know when disclosure would cause specific and material harm \u2026The balancing test is fact specific: the proponent of non-disclosure must show a probability of harm that is significant enough to override the presumption of access.\u201d<\/p>\n

The judge added that \u201cArizona courts have consistently recognized a family\u2019s right to prevent public release of graphic or intimate records involving a loved one\u2019s death.\u201d<\/p>\n

According to the letter, the information Kiser sought to redact offers a \u201cmoment-by-moment written depiction of a video capturing a young child\u2019s death.\u201d<\/p>\n

\u201cThe vivid and granular nature places it closer to the kind of graphic, emotionally disturbing material that \u2026 may justifiably be shielded from public release,\u201d the judge stated.<\/p>\n

While it was argued that the \u201cpublic cannot fully evaluate the police investigation\u201d without seeing \u201cevery portion of the report,\u201d the court ultimately agreed<\/a> with Kiser.<\/p>\n

\u201cIts disclosure would serve no purpose other than satisfying morbid curiosity and, as [Emilie] persuasively argues, would risk exploitation by bad actors,\u201d the docs stated.<\/p>\n

Kiser reacted to the legal win on Friday via a statement by her attorney shared with Us<\/em>, \u201cWe\u2019re grateful to Judge Whitten for carefully balancing the important interests at stake and allowing a narrow but meaningful redaction to the Chandler police report, removing two pages that detail the graphic final moments of Trigg\u2019s life. These redactions do not alter any material facts of the accident, but they protect the dignity of a little boy whose memory should reflect the love and light he brought to the world.\u201d<\/p>\n
