Emilie Kiser<\/strong>\u2019s husband, Brady Kiser<\/strong>, noticed something unusual in the backyard of their family home before finding 3-year-old son Trigg in the pool.<\/p>\n

In a redacted police report obtained by Us Weekly<\/em> on Friday, August 8, Brady told authorities he was inside feeding Trigg and now 4-month-old son Teddy while watching an NBA playoff game between the New York Knicks and Boston Celtics. (The report indicated that Brady placed a bet<\/a> on the game prior to Trigg\u2019s death, noting that his attention was \u201cdivided\u201d on the May 12 night.)<\/p>\n

Trigg, meanwhile, went into the backyard and tripped into the pool<\/a> after playing with an inflatable chair while Brady was allegedly inside.<\/p>\n

When Brady was asked to recall the events during a second line of questioning, he claimed to have looked outside and saw the dog watching the pool and having a \u201cpoor feeling as soon as [he] saw it, it was out of the ordinary to see him standing there looking in the water as he was.\u201d<\/p>\n

The former professional quarterback, 45, took to Instagram Story on Sunday, April 30, to share a photo of Barrett\u2019s family. \u201cThe Brady\u2019s love you,\u201d Brady wrote. Brady claimed that he \u201cstood up\u201d and \u201cimmediately\u201d went outside, where he found his eldest son in the pool.<\/p>\n

The police report also indicated that Trigg was outside unsupervised<\/a> for more than nine minutes and was in the water for about seven of those minutes, despite Brady initially claiming the incident occurred in the span of only a few minutes. Authorities claimed that Brady\u2019s statements \u201cdo not match\u201d what the surveillance video showed, alleging that he was \u201cnot aware\u201d of what Trigg was doing and \u201cnot watching him.\u201d<\/p>\n

Days after Trigg was pulled unconscious from the backyard pool, the Chandler, Arizona, Police Department confirmed to Us<\/em> that he died on May 18. Investigators later reccomended that Brady be charged with a Class 4 felony charge of child abuse, however, the local Attorney\u2019s Office ultimately opted against pursuing the charge.<\/p>\n

\u201cSurveillance video from outside the home showed how the drowning occurred and the actual timeline of events,\u201d a statement read. \u201cIn order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.\u201d<\/p>\n
