Denise Richards<\/strong><\/a> is taking legal action to get Aaron Phypers<\/strong> and his family out of the home they once shared together.<\/p>\n

According to court documents obtained by Us Weekly<\/em> on Wednesday, August 20, Richards, 54, filed a declaration asking the judge to remove Phypers, 52, and his family from the house they lived in during their marriage so she can return to the property to retrieve some personal belongings she left behind following her move.<\/p>\n

\u201cWhen I moved out over two years [ago], I left many of my personal items and my late mother\u2019s items at the house based on Aaron telling me that his family would be moving back to Canada and we would be moving back into the [home],\u201d the docs read.<\/p>\n

Richards\u2019 dogs have also allegedly been at the property since May while she recovered from two surgeries. Richards claimed that Phypers agreed to that arrangement.<\/p>\n

\n\t\t\tDenise Richards\u2019 estranged husband, Aaron Phypers, called the cops on her over the weekend after she allegedly showed up at his home unannounced, Us Weekly can report. Sources close to Phypers, 52, tell Us he phoned the Los Angeles Sheriff\u2019s Department on Sunday, August 3. The insider claimed that Richards, 54, showed up at the [\u2026]\t\t<\/p>\n<\/div>\n

However, Richards alleged that she received a message from the property\u2019s landlord last month stating that he will begin \u201ceviction proceedings\u201d starting Saturday, August 23, and demanded that the residence be vacated. The landlord allegedly told Richards that Phypers has not been responsive to his messages and has not been paying rent. According to Richards, she informed Phypers in January that he would be responsible for the home\u2019s payment.<\/p>\n

In the docs, Richards stated that she is worried about her belongings possibly getting damaged and wants to be able to retrieve the items and her animals without Phypers being present.<\/p>\n

Richards claimed that \u201cAaron and his parents and brother have severely damaged\u201d the home as it was \u201cin a state of disarray.\u201d She included images that showed patches of removed flooring, several boxes, articles of clothing and papers scattered around.<\/p>\n

\n\t\t\tDenise Richards is leveling new allegations against her estranged husband, Aaron Phypers, amid their contentious divorce. \u201cIn addition to the repeated abuse perpetrated by Mr. Phypers against Ms. Richards throughout the parties\u2019 marriage, Mr. Phypers has continued to harass Ms. Richards since being served with the Temporary Restraining Order by, among other things, disseminating private [\u2026]\t\t<\/p>\n<\/div>\n

In her filing, Richards asked that Phypers and his family not be present at the property on Saturday while she retrieves her items and pets. She also asked that there will not be any recording or listening devices at the property during that time.<\/p>\n

Us<\/em> has reached out to Phypers for comment.<\/p>\n

Phypers submitted a response on Wednesday stating that he does not \u201cconsent to [the] order requested\u201d by Richards.<\/p>\n

\u201cThere is no emergency or exigent circumstance and the court should deny [her] ex parte request,\u201d the docs read.<\/p>\n

He also asked if the court does consider issuing Richards\u2019 order, he would like the \u201copportunity to retrieve\u201d his own \u201cpersonal belongings\u201d from the former residence where Richards currently resides.<\/p>\n
