For more than 30 years, Kevin Costner<\/strong> has been toiling on Horizon: An American Saga<\/em>, an epic film series about the American West. His goal, he explained Aug. 18, has been to address themes \u201crelevant to that time period, including the impact of the American Civil War, the relationship between settlers and Native Americans, the challenges faced by European immigrants seeking a better life, and the foundational role played by women of the time\u201d including \u201cthe violence and difficult conditions they faced.\u201d<\/p>\n But according to a stand-in on the second movie in his Horizon series, that vision has been deeply compromised. In May, stuntwoman Devyn LaBella<\/strong> filed suit against the actor and the saga\u2019s production companies claiming she was \u201cthe victim of a violent, unscripted, unscheduled rape scene\u201d directed by the Oscar winner for the second of four planned Horizon<\/em> movies while serving as a double for actress Ella Hunt<\/strong> in 2023. In her sexual harassment and hostile workplace environment complaint, as reported by Deadline<\/em><\/a>, Devyn, who\u2019s seeking unspecified damages, alleges she was left with \u201cpermanent trauma\u201d she\u2019ll have to \u201caddress for years to come.\u201d The May 2 filing took place just one day after Kevin was blindsided by divorce papers from second wife Christine Baumgartner<\/strong>.<\/p>\n Marty Singer<\/strong>, the 70-year-old star\u2019s lawyer, initially called the suit a \u201cshakedown,\u201d per The New York Times<\/em><\/a>. Now, Kevin has gone further, branding Devyn\u2019s claims a \u201cbold-faced lie\u201d in his own court filing. \u201cMy belief is that Devyn\u2019s claims were designed, through the use of false statements and sensationalistic language, to damage my reputation,\u201d the Hollywood legend wrote in a lengthy declaration<\/a> published by Deadline<\/em><\/a>, calling the claims against him \u201cabsolutely false.\u201d He alleges Devyn wants to \u201cembarrass\u201d him and hurt the Horizon<\/em> movies \u201cin order to gain a massive and unjustified payday.\u201d Moreover, having to read about and address her allegations \u201cinvolving the words \u2018rape\u2019 and \u2018assault,\u2019\u201d Kevin added, \u201chas been an absolute nightmare.\u201d<\/p>\n A source tells Star<\/em> the Dances With Wolves<\/em> star \u201cis fighting these heinous claims with everything he\u2019s got,\u201d adding that the three-time Golden Globe winner \u201chas said from the start that it\u2019s a classic stick-up lawsuit that has zero merit whatsoever.\u201d His lawyer has asked a judge to dismiss Devyn\u2019s suit at a Sept. 18 hearing.<\/p>\n According to Devyn, Kevin improvised a scene in which an actor aggressively raked up her skirt and straddled her. In June, she amended her lawsuit to include text messages she exchanged with the film\u2019s intimacy coordinator, Celeste Chaney<\/strong>, a day after the shot was blocked in which she described it as an \u201cabomination\u201d and listed questions about how it was handled before asking, reported by Variety<\/em><\/a>, \u201cWho is gonna take responsibility for the abuse of power, negligence and ignorance on set?\u201d The intimacy coordinator, who wasn\u2019t present during the alleged incident, has backed Devyn, calling the shot a \u201cviolent rape scene\u201d that \u201cwas unexpectedly sprung on the actors and stunt professionals,\u201d also noting Devyn \u201cdid not have the appropriate modesty garments to ensure adequate coverage, safety or protection.\u201d<\/p>\n Kevin maintains that\u2019s not what happened. He says Devyn\u2019s \u201cprivacy was fully maintained\u201d \u2014 which was confirmed in explosive photos of her and others taken on set that day that he submitted with his filing \u2014 during the moments in question. In a special motion<\/a> to strike Devyn\u2019s complaint, Kevin\u2019s attorney stated that Devyn \u201cwas laughing and smiling during the blocking of the shot,\u201d which Kevin clarifies was rehearsed but never filmed, and was only \u201ca buildup and foretelling\u201d of a rape that occurs offscreen and not itself a simulated rape. According to the director, it involved \u201cthe simple act of moving the hem of the dress from the ankle to the knee\u201d and an actor swinging his leg over her and ending up \u201con all fours\u201d to create \u201ca moment of absolute clarity for the audience to absorb what would happen offscreen.\u201d<\/p>\n In addition to his own account, Kevin\u2019s legal team submitted a gushing text Devyn sent to her supervisor nine days later thanking him for \u201cthese wonderful weeks!\u201d as well as \u201cthe sworn testimony of a dozen respected, veteran film crew members with personal knowledge of the facts at issue.\u201d<\/p>\n Two of those have surfaced publicly and support Kevin\u2019s version of events. Wade Allen<\/strong>, the stunt coordinator who hired and supervised Devyn and was there during shot blocking, insisted that \u201cat no point that day did she evidence any distress or discomfort, or any concern about what she had been asked to do,\u201d per Variety<\/em><\/a><\/em>, adding that Devyn gave him a thumbs-up before and after the run-through of the scene he said involved \u201cno intimacy, no nudity, no sexual conduct or sexual movement of any kind.\u201d<\/p>\n The other performer in the shot, actor Roger Ivens<\/strong>, also challenged what he called a \u201cfalse and sensationalist\u201d description of their scene as depicting a violent rape. \u201cIt is not what happened,\u201d Roger said. \u201cThis was not in any way, shape, or form a simulated sex scene.\u201d<\/p>\n \u201cThe truth matters,\u201d Kevin wrote in his declaration, which is why, \u201ceven at the high cost of this lawsuit\u201d \u2014 both \u201cfinancial and personal,\u201d he clarified \u2014 \u201cI will always speak up to defend myself and my crew against false allegations.\u201d He also countered Devyn\u2019s claim that she suffered career consequences for speaking out and hasn\u2019t been hired by the stunt coordinator since May 2023. It\u2019s \u201cabsurd,\u201d he said in his declaration, since filming on Horizon III<\/em> hasn\u2019t started.<\/p>\n Devyn\u2019s attorney James Vagnini<\/strong> hit back at Kevin, calling his account \u201ccontinued evidence that one of Hollywood\u2019s most powerful men is trying to skirt accountability for reckless and harmful behavior.\u201d According to her lawyer\u2019s statement which was shared with the celebrity.land<\/em><\/a>, \u201cclaims that Devyn\u2019s professional demeanor on set discredits the assault she endured is not only insulting to victims everywhere, but directly disproven by multiple eyewitness accounts and irrefutable evidence from the immediate aftermath of the incident, including phone calls, text messages and a scathing report from the production\u2019s intimacy coordinator. This baseless motion is nothing but a desperate delay tactic from a panicked legal team with no real defense.\u201d The only things damaging Kevin\u2019s reputation, Devyn\u2019s legal team added, \u201care his own reckless, harmful behavior and the offensive narrative he\u2019s spreading to cover it up.\u201d<\/p>\n The legal drama isn\u2019t the only issue plaguing Kevin\u2019s Horizon<\/em> series. He self-funded much of his passion project, investing at least $38 million and even mortgaging some of his property to help finance it, he told GQ<\/em><\/a>. After the first installment, which combined with the second had a reported budget of $100 million, made just $38.7 million at the worldwide box office last summer, the theatrical release of Chapter II<\/em> was delayed \u2014 something Kevin confessed last September during an appearance at the Venice Film Festival, Variety<\/em><\/a> reported, \u201cprobably was a reaction\u201d to Chapter I<\/em>\u2019s underperformance. \u201cIt didn\u2019t have overwhelming success.\u201d<\/p>\n With an estimated net worth of $250 million, the Bodyguard<\/em> star \u201cis still a very wealthy man,\u201d the source tells Star<\/em>. \u201cBut he\u2019s been hit hard with some major financial setbacks in recent times.\u201d His contentious divorce from second wife Christine, 51, the mother of his three youngest kids (Kevin is also dad to four other children from two prior relationships), ended with a judge deciding in 2023 that their prenup would stand.
