The brief defends the placement of a comma that opponents said was misleading about tax fund numbers.<\/p>\n<p dir=\"ltr\">Appellants include the three Norman residents who filed a referendum petition to send the entertainment district to a public vote, Pamela McCoy-Post, Paul Arcaroli and Richard Sondag. Appellees include those who filed a lawsuit challenging the gist, or summary, of the petition.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">\u201cAppellees&#8217; claims involve a whole lot of agonizing over each word, each phrase, each comma, and each punctuation mark to manufacture something wrong with the gist,\u201d the brief states. \u201cEven after all this, it is clear that the gist in this case does not contain any omissions or statements which would have deceived, misled, or acted as a fraud upon a potential signer.\u201d<\/p>\n<p dir=\"ltr\">The brief also states that opponents claimed the gist of the petition did not include specific details like a 3% sales tax figure. In October, less than a month later, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/university-north-park-entertainment-district-rock-creek-oklahomans-for-responsible-economic-development-ou-university-of-oklahoma-petition-norman-residents\/article_3935f83c-8cb6-11ef-b8d8-a79321e3931f.html\" target=\"_blank\">petitioners submitted 11,602 signatures<\/a>, exceeding the required 6,098. City Clerk Brenda Hall <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/city-clerk-certifies-over-10-000-signatures-for-petition-to-bring-entertainment-district-to-public\/article_75fd6bdc-9ca7-11ef-9541-2b6ccc8d9627.html\" target=\"_blank\">certified 10,689 of the 11,602 signatures<\/a>.\u00a0<\/p>\n<p dir=\"ltr\">In November, four Norman business leaders, Kyle Allison, director of Allison\u2019s FUN Inc.; Vernon McKown, CEO of Ideal Homes &amp; Neighborhoods; David Nimmo, former president and CEO of Chickasaw Nation Industries; and Dan Quinn, former Ward 8 councilmember, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/city-of-norman-rock-creek-entertainment-district-university-of-oklahoma-petition-protesting-legal-notice\/article_ddb19830-a6e2-11ef-a710-cb32812177f3.html\" target=\"_blank\">filed a lawsuit challenging the gist<\/a> of the public vote proposed by the petition.<\/p>\n<p dir=\"ltr\">On Feb. 21, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/oklahomans-for-responsible-economic-development-referendum-petition-judge-jeff-virginuniversity-north-park-court-hearing\/article_20ec18a8-f0a0-11ef-b948-d7fa75a51ab6.html#:~:text=Independent%20local%20journalism%20for%20OU%20and%20Norman%20since%201916&amp;text=According%20to%20court%20records%2C%20Judge,ballot%20for%20a%20public%20vote.\" target=\"_blank\">Cleveland County Judge Jeff Virgin ruled<\/a> that the gist contained in the petition was insufficient and that it did not comply with an <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/oksenate.gov\/sites\/default\/files\/2019-12\/os34.pdf\" target=\"_blank\">Oklahoma Statute<\/a> requiring a referendum petition to summarize the nature of the proposed referendum vote in a manner that can be understood by those who do not practice law.<\/p>\n<p dir=\"ltr\">On April 28, Norman residents <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/rock-creek-entertainment-district-university-north-park-oklahoma-supreme-court-appeal-petition-invalid\/article_aabdfbb5-4815-4aca-9ac2-9d2951d7c9fe.html\" target=\"_blank\">filed a brief<\/a> with the Oklahoma Supreme Court appealing for the reversal of Virgin\u2019s ruling.<\/p>\n<p dir=\"ltr\">On April 24, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/rock-creek-entertainment-district-university-north-park-notice-of-default-norman-tax-increment-finance-district\/article_f223c790-4736-431d-8276-8058fd9ed6d3.html\" target=\"_blank\">a notice of default<\/a> to the city of Norman stated that if the Norman Tax Increment Finance Authority does not approve the phasing plan by May 24, the city could be sued. On May 20, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.oudaily.com\/news\/norman-city-council-residents-university-north-park-rock-creek-entertainment-district-phasing-plan-approval\/article_62b9529b-91cd-425c-b7b3-315b298647e4.html\" target=\"_blank\">city council approved<\/a> the phasing plan for the project in an 8-1 vote.
