Following a massive victory in his New York state case, Luigi Mangione<\/strong>\u2018s lawyers have filed a motion requesting the dismissal of the federal indictment against the accused UnitedHealthcare CEO killer.<\/p>\n

In the 114-page filing obtained by Us Weekly<\/em> on Saturday, September 20, Karen Friedman Agnifilo<\/strong>, Marc Agnifilo<\/strong> and Jacob Kaplan<\/strong> lay out six ways that their \u201csmart, kind, well-rounded\u201d client\u2019s \u201cconstitutional rights have been violated,\u201d arguing that either his \u201cindictment should be dismissed\u201d or \u201cthe government should be precluded from prosecuting this matter as a death penalty case.\u201d<\/p>\n

First, Mangione\u2019s attorneys claim U.S. Attorney General Pam Bondi<\/strong> made \u201cextrajudicial statements\u201d in an April 1 press release<\/a> and Instagram post<\/a> directing prosecutors to seek the death penalty. (At the time, Bondi said, \u201cLuigi Mangione\u2019s murder of Brian Thompson<\/strong> \u2014 an innocent man and father of two young children \u2014 was a premeditated, cold-blooded assassination that shocked America.\u201d)<\/p>\n

An \u201cextrajudicial statement\u201d is any written or oral statement made outside of court. Lawyers are often limited in what they can say publicly, especially if those statements could prejudice an ongoing legal proceeding.<\/p>\n

Garnett signed a court document on Monday, August 4, ordering the Metropolitan Detention Center (MDC) in Brooklyn, New York, to \u201cprovide Mr. Mangione with the laptop prepared by [\u2026]\t\t<\/p>\n<\/div>\n

Second, the legal team expresses concern that \u201cthe government allowed the grand jury to be prejudiced\u201d by not screening them for \u201cexposure\u201d to Bondi\u2019s \u201cillegal and prejudicial statements.\u201d<\/p>\n

Third, Mangione\u2019s counsel claims he was denied an opportunity to \u201cpresent mitigating information\u201d prior to Bondi calling for the death penalty, which they believe was politically motivated. (Bondi said in her press release and Instagram post that she was carrying out President Donald Trump<\/strong>\u2018s \u201cagenda to stop violent crime.\u201d)<\/p>\n

Fourth, the lawyers state that \u201creturning a death-eligible indictment through unconstitutional and prejudicial conduct violates Mangione\u2019s due process rights by forcing him to be tried before a death-qualified jury,\u201d which they argue \u201ccreates a great disadvantage for the defendant.\u201d<\/p>\n

Fifth, Mangione\u2019s attorneys say the federal death penalty is \u201cimposed in an arbitrary and capricious fashion,\u201d which leads to their final point \u2014 that capital punishment itself is \u201cunconstitutional.\u201d<\/p>\n

Additionally, the legal team decries Mangione being \u201cperp walked\u201d by \u201cscores of law enforcement officials\u201d and New York City Mayor Eric Adams<\/strong> like a \u201ccaptured cartel chief or comic book villain\u201d shortly after his arrest in December 2024, claiming it was \u201cdone purely to dehumanize\u201d their client and \u201chad no legitimate \u2026 purpose.\u201d<\/p>\n
