OpenAI\u2019s Sora 2 includes likeness protections for celebrities who don\u2019t opt in, but that doesn\u2019t apply to \u201chistorical figures\u201d and dead celebrities.<\/h2>\n
OpenAI\u2019s Sora 2 has launched the company back into the headlines since it backpedaled<\/a> on its earlier announcement that rights holders would have to opt out rather than opt in. Now, it turns out that OpenAI\u2019s measures to \u201cblock depictions of public figures\u201d by default do not pertain to public figures who have died.<\/p>\n Thus far, celebrities being posthumously inserted into video creations generated by Sora 2 include Tupac Shakur, Malcolm X, Bruce Lee, Michael Jackson, Stephen Hawking, Fred Rogers, Kurt Cobain, Martin Luther King Jr., and many more.<\/p>\n \u201cPlease stop sending me AI videos of dad,\u201d wrote Robin Williams\u2019 daughter Zelda in a now-deleted Instagram Story posted Monday. \u201cStop believing I\u2019ll wanna see it or that I\u2019ll understand; I don\u2019t and I won\u2019t\u2026 It\u2019s dumb, it\u2019s a waste of time and energy, and believe me, it\u2019s NOT what he\u2019d want.\u201d<\/p>\n The loophole at play here stems from Sora 2\u2019s \u201ccameos\u201d feature, which OpenAI notes that living users can opt in to by scanning their own face with a smartphone to \u201cdrop yourself straight into any Sora scene with remarkable fidelity.\u201d<\/p>\n However, deceased public figures aren\u2019t able to consent to Sora 2\u2019s cameo feature, and OpenAI seems to be just fine with that. \u201cWe do allow the generation of historical figures,\u201d an OpenAI spokesperson told<\/a> PCMag.<\/p>\n OpenAI has already been forced to modify the way Sora handles fictional copyrighted works. So why are there no protections for the likenesses of deceased celebrities? Should the estates of these figures be required to contact OpenAI to opt out, when they never consented to these figures being \u201copted in\u201d in the first place?<\/p>\n CEO Sam Altman wrote over the weekend that copyright holders have to opt in to allow their IP to be used in Sora 2\u2019s content, rather than having to opt out<\/a>. He also promised that \u201cmany more\u201d changes would be forthcoming, and to \u201cexpect a very high rate of change from us.\u201d So, perhaps more obvious protections for the likenesses of the deceased will roll out.<\/p>\n Control over the AI-generation of a performer\u2019s likeness was a major part of the 2023 SAG-AFTRA strike<\/a>, which resulted in a contract that gave members full control over the use of digital replicas in future union projects. It remains to be seen how OpenAI will adapt to widespread criticism as Sora 2 usage ramps up.<\/p>\n<\/div>\nOpenAI says cameo users are \u201cin control of your likeness end-to-end,\u201d and the feature is designed to \u201censure that your audio and image likeness are used with your consent.\u201d Cameo users can also revoke access at any time, and have moderation control over other users\u2019 videos created with their own scan.<\/h4>\n
