And, at every turn, the city has pushed back. <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.dallasnews.com\/news\/2015\/07\/22\/at-ny-times-conference-jason-roberts-explains-how-breaking-dallas-laws-made-a-better-dallas\/\" rel=\"\">It\u2019s like I once wrote<\/a>: Roberts, the Oak Cliff urbanist-turned-Bishop Arts entrepreneur, figured out a long time ago that \u201csometimes you gotta break a few of Dallas City Hall\u2019s more antiquated laws to make a better Dallas.\u201d<\/p>\n<p class=\"body-text-paragraph\">That was 10 years ago. Now let me take you all the way back to Oct. 5.<\/p>\n<p class=\"body-text-paragraph\">On that night less than three weeks ago, one of the city\u2019s code compliance officers walked into one of the four Bishop Arts businesses Roberts co-owns, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/shorts\/Wi5aLK_27jo\" rel=\"\">the New Orleans-style bar and restaurant Revelers Hall<\/a>, which holds 65 patrons, not including the brass bands that regularly fill its calendar. An officer handed a manager a notice of violation, which alleged the venue was operating as an \u201cunpermitted use\u201d and was creating \u201cloud and disturbing noises and vibrations.\u201d<\/p>\n<p class=\"body-text-paragraph\">Revelers Hall, which opened in 2019 and is <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.visitdallas.com\/blog\/live-music-for-groups-in-dallas\/\" rel=\"\">hailed by Visit Dallas a live-music must-visit<\/a>, was given zero days to correct the two violations. Another notice of violation was delivered 11 days later.<\/p>\n<p class=\"body-text-paragraph\">The noise thing is just silly when you consider that Revelers Hall is the kind of place where grinning passersby stop long enough to shoot photos and <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=XV6GZkl013c&amp;list=RDXV6GZkl013c&amp;start_radio=1\" rel=\"\">videos<\/a> through the usually wide-open front doors. Because there are rules on the books prohibiting restaurants from charging cover. They\u2019ve just never been enforced. That\u2019s how Roberts and co-owner Amy Wallace Cowan pay the musicians who made their New Orleans-scented jazz joint one of Visit Dallas\u2019 go-tos.<\/p>\n<p class=\"body-text-paragraph\">Yet the city now says that\u2019s not allowable under <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/codelibrary.amlegal.com\/codes\/dallas\/latest\/dallas_tx\/0-0-0-80819\" rel=\"\">the section of city code that regulates inside commercial amusements<\/a>, which could mean anything from an adult cabaret to a skating rink. The city maintains that as soon as a business adds an entertainment fee, that \u201creclassifies the business use from a restaurant to a Commercial Amusement (Inside) use.\u201d<\/p>\n<p class=\"body-text-paragraph\">But that section of the city code was seldom, if ever, enforced until the city recently expanded its Nighttime Entertainment Strike Team, whose operations will cost $244,838 this fiscal year and $334,612 next fiscal year, according to <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/dallascityhall.com\/departments\/budget\/financialtransparency\/AnnualBudget\/FY%202025-26%20Proposed%20Budget\/0.%20FY%202025-26%20Proposed%20Annual%20Operating%20and%20Capital%20Budget%20-%20Revised%209.24.25.pdf\" rel=\"\">the city\u2019s newly adopted budget<\/a>. That five-person team is supposed to collaborate with Dallas Fire-Rescue and Convention and Event Services to, among other things, \u201cproactively address nuisance conditions.\u201d By, apparently, targeting businesses that are anything but nuisances.<\/p>\n<p class=\"body-text-paragraph\">The only district specifically mentioned in the new budget is Deep Ellum. Which is where the Cajun-flavored Free Man, another Visit Dallas recommendation, also got dinged with the same alleged fee-charging violation though it, too, has been <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.dallasobserver.com\/food-drink\/the-free-man-cajun-cafe-brings-cajun-food-with-a-side-of-jazz-to-deep-ellum-7044449\/\" rel=\"\">charging for live music since it opened in 2011<\/a>. <\/p>\n<p class=\"body-text-paragraph\">The Free Man\u2019s owner, John Jay Myers, posted to Facebook on Oct. 9 that the cover charge \u201c<a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.facebook.com\/johnjaymyers\/posts\/10232589029449345\" rel=\"\">guaranteed a reasonable, livable wage<\/a>\u201d for the musicians. Pool \/ Staff Photographer<\/p>\n<\/figcaption><\/figure>\n<p class=\"body-text-paragraph\">Mayor Pro Tem Jesse Moreno, whose district includes Deep Ellum, texted me Wednesday saying he has asked \u201cstaff to review and offer suggestions for updating our code to ensure that the heart and soul of Deep Ellum is protected: our live music!\u201d He said he held a meeting this week with the Deep Ellum Foundation and neighborhood business owners to make sure they understand what\u2019s going on.<\/p>\n<p class=\"body-text-paragraph\">\u201cUnfortunately,\u201d he said, \u201cthere have been a lot of changes to the teams who work to manage these issues at the city. Moving forward, we need clear direction from city staff in what the function and role is from the night time economy office.\u201d<\/p>\n<p class=\"body-text-paragraph\"><a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.wfaa.com\/article\/news\/local\/deep-ellum-cover-charge-city-of-dallas-the-free-man\/287-e385f2bc-3455-4789-b5a0-e7ae4e4fd6ec\" rel=\"\">The Free Man\u2019s story got picked up by the TV news<\/a> a few days ago, prompting Roberts and Cowan to take to social media to share stories of the strike team\u2019s move into Bishop Arts. At which point I called Roberts to discuss his latest chapter in what appears to be his neverending tale of How to Fight City Hall.<\/p>\n<p class=\"body-text-paragraph\">The city told Roberts and Cowan they could add a \u201cservice fee\u201d to the bill instead of charging a cover for live music. But customers saw that, figured it meant tip, and the bar staff was left empty-handed. And increasing prices, Roberts said, is just a nonstarter.<\/p>\n<p class=\"body-text-paragraph\">\u201cIf we have to adjust and pivot, we will figure that out,\u201d he said over breakfast Wednesday at Trades Delicatessen, which he and Cowan run next door to their Jaquval brewpub and around the corner from their Oddfellows eatery. \u201cBut Amy\u2019s point is, we\u2019ve been a good partner, we\u2019ve been working well. And we\u2019ve figured out this interesting way to actually pay talent what they deserve for 6\u00bd years. Maybe the city would look at us and be like, \u2018OK, so why don\u2019t we rewrite some of the rules based on this model?\u2019 <\/p>\n<p class=\"body-text-paragraph\">\u201cEveryone says no, and that\u2019s where everyone stops. We\u2019re going to have to figure out how we\u2019re going to work around it.\u201d He laughed. \u201cI\u2019ve made a career of breaking rules.\u201d<\/p>\n<p class=\"body-text-paragraph\">\u201cYou mean not taking no for an answer,\u201d I tell him.<\/p>\n<p class=\"body-text-paragraph\">\u201cNot taking no for an answer, yes,\u201d he said, grinning under his beard. \u201cAnd pushing back on the system. That\u2019s what happened 15 years ago, when <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.dallasobserver.com\/news\/taking-oak-cliffs-better-block-to-atlanta-and-the-congress-for-the-new-urbanism-7142882\/\" rel=\"\">he calmed a chaotic North Oak Cliff intersection by temporarily installing pedestrian amenities and pop-up shops<\/a>. That\u2019s what happened 13 years ago, when <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.dallasnews.com\/news\/transportation\/2012\/09\/18\/knox-street-to-become-a-european-crossroads-with-a-two-lane-cycle-track-to-katy-trail-at-month-s-end\/\" rel=\"\">he helped install bike lanes along Knox Street<\/a>.<\/p>\n<p class=\"body-text-paragraph\">City staffers told him all of that couldn\u2019t be done, shouldn\u2019t be done. Roberts, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/gooakcliff.org\/history\" rel=\"\">a founding member of Go Oak Cliff<\/a>, did it anyway. As a result, <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.archdaily.com\/218310\/tedx-how-to-build-a-better-block-jason-roberts\" rel=\"\">the TEDTalker turned the phrase Better Block<\/a> into <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.dallasnews.com\/news\/2016\/01\/13\/how-small-change-in-north-oak-cliff-led-to-a-big-knight-grant-for-better-block\/\" rel=\"\">an international movement<\/a> and got himself an invite to the Obama White House where <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/obamawhitehouse.archives.gov\/blog\/2012\/08\/07\/finding-inspiration-champions-change\" rel=\"\">he was hailed as a Champion of Change<\/a>. And Bishop Arts was quickly overrun with tourists from North Dallas who never considered venturing to <i>that side <\/i>of the Trinity River.<\/p>\n<p class=\"body-text-paragraph\">\u201cJason is how I discovered North Oak Cliff, with the Mardi Gras Parade,\u201d staged annually by Go Oak Cliff, West told me Wednesday. \u201cHe probably doesn\u2019t know that.\u201d<\/p>\n<p class=\"body-text-paragraph\">And this is the thanks he gets.<\/p>\n<p class=\"body-text-paragraph\">Thursday morning, I also heard from Simon McDonald, owner of Lower Greenville\u2019s Libertine Bar, which opened in 2006, making it one of the area\u2019s oldest operators. He said the strike team\u2019s down there, too. The bar closes at midnight, but McDonald said he was fined for closing his kitchen at 10 p.m. <\/p>\n<p class=\"body-text-paragraph\">\u201cWe had to hire additional staff and do a late-night menu to placate them,\u201d McDonald said. Something he\u2019d never had to do in nearly 20 years of operation.<\/p>\n<p class=\"body-text-paragraph\">I sent a few unanswered emails to Rosa Fleming, director of Convention and Event Services, asking why this strike team is going after popular businesses without histories of causing problems. Because, from the outside, this looks like bad business.<\/p>\n<p class=\"body-text-paragraph\">In 2023, the Pennsylvania company Tourism Economics and Visit Dallas published the report <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/dallascityhall.com\/departments\/conventioneventservices\/nighttime-economy\/Documents\/Dallas%20Nightlife%20(Final)%2004-11-2024%20-%20compressed.pdf\" rel=\"\"><i>\u201d<\/i>Economic and Fiscal Contributions of the Nightlife Economy in Dallas, TX<\/a>,&#8221; which said Bishop Arts, Deep Ellum and Greenville Avenue alone account for more than $850 million in total economic impact. Said the report, \u201cthe Dallas nightlife economy is poised to evolve to continue its role as a key driver in the regional economy.\u201d<\/p>\n<p class=\"body-text-paragraph\">Unless the strike team gets its way.<\/p>\n<p class=\"body-text-paragraph\">\u201cI couldn\u2019t be more frustrated,\u201d West told me. \u201cOur code is just antiquated, and staff hasn\u2019t even looked at older code provisions for retail, restaurants and storefront uses. What\u2019s frustrating to me is it\u2019s taken this situation for us to open it up and look at it. That\u2019s usually the case, I guess.
