County Superior Court judge on Wednesday dismissed the complaint from Diesel\u2019s accuser, Asta Jonasson, citing a technicality.<\/p>\n<p>Jonasson said in her lawsuit, <a rel=\"nofollow\" target=\"_blank\" class=\"link\" href=\"https:\/\/www.latimes.com\/entertainment-arts\/story\/2023-12-21\/vin-diesel-accused-sexual-battery-former-assistant-lawsuit\">filed in December 2023<\/a>, that she served as Diesel\u2019s assistant in 2010 during the filming of \u201cFast Five\u201d in Atlanta and alleged the actor sexually assaulted her in a hotel room. <\/p>\n<p>Her lawsuit raised 10 claims, including sexual battery, retaliation and multiple violations of California\u2019s Fair Employment and Housing Act. The complaint also sought action against Diesel\u2019s One Race Films production company and its president, Samantha Vincent, Diesel\u2019s sister.<\/p>\n<p>Judge Daniel M. Crowley called Jonasson\u2019s argument \u201cuntenable\u201d and in conflict with the intention of the state\u2019s legal code in his dismissal document. Also, since the sexual assault is alleged to have happened in Georgia, the judge said California was not the right jurisdiction in which to file the complaint.<\/p>\n<p>Crowley said that California law could not be \u201capplied to any of Plaintiff\u2019s claims.\u201d<\/p>\n<p>The case was set to go to trial in February prior to Wednesday\u2019s decision. Jonasson\u2019s attorney Matthew T. Hale said in a statement Wednesday that \u201cthe Court did not decide anything about the truth of Ms. Jonasson\u2019s allegations.\u201d<\/p>\n<p>\u201cThe ruling was based on a legal technicality,\u201d Hale said. \u201cWe disagree with the ruling, and we are assessing next steps.\u201d<\/p>\n<p>A legal representative for Diesel did not immediately respond to a request for comment on Wednesday. <\/p>\n<p>In her complaint, Jonasson alleged Diesel groped her, pinned her to a wall and put her hand on his genitals without her consent during the hotel room encounter.
