Legislation that will keep dangerous criminals locked up, end the cycle of less serious offenders going in and out of prison and end the crisis in our prisons has become law today.<\/p>\n
The Sentencing Act, which has now received Royal Assent, will grip the prison crisis on the brink of collapse which this government inherited. It will make sure future governments always have the prison places needed to keep people safe, with the most dangerous offenders locked up and tough community restrictions meaning those\u00a0released from prison enter a period of\u00a0supervision\u00a0tailored to their risk and the type of crime they committed.\u00a0This\u00a0includes\u00a0the biggest ever expansion in tagging\u202fand the use of restriction zones to better protect victims.\u202f\u00a0\u00a0<\/p>\n
The most serious offenders – those on life\u00a0sentences, IPP, and extended\u202fdeterminate\u00a0sentences\u00a0– will not be\u00a0released any earlier than\u00a0they are now.\u00a0<\/p>\n
Alongside this, the probation budget will be increased by up to \u00a3700 million over the next three years\u00a0to\u00a0bolster\u00a0community justice, including the probation service\u2019s\u00a0resource and ability to tag offenders. The government is also\u00a0investing in\u00a0new technology\u00a0to reduce admin so staff can focus on work that reduces reoffending.\u00a0<\/p>\n
Commenting on\u00a0Royal Assent,\u00a0Sentencing Minister Jake Richards said:\u00a0<\/p>\n
\nThis\u00a0government inherited\u00a0a prison system\u00a0bursting at the seams and at breaking point\u00a0\u2013 risking the total breakdown of law and order in this country.\u00a0<\/p>\n
Urgent, bold action was needed to keep the public safe. These reforms will make sure prisons never run out of space again and dangerous offenders are kept off our streets, while putting victims first with much tougher punishments for offenders outside jail.\u202f\u00a0<\/p>\n
We are already delivering the biggest prison expansion since the Victorian era, but the reality is we cannot just build our way out of the chaos \u2013 it must go hand in hand with radical reform to avoid another ticking timebomb.<\/p>\n<\/blockquote>\n
The measures in the Sentencing Act will not take effect\u00a0immediately, giving the probation service and victims support groups the time needed to prepare for the changes\u00a0coming in.\u00a0Implementation will be phased over the next two years, with changes to how long offenders stay in prison when they are recalled expected to begin in the coming months, and the earned release model to be rolled out in the Autumn.<\/p>\n
The Sentencing Act follows the Independent Sentencing Review led by David Gauke, published in May.\u00a0<\/p>\n
Key reforms in the Act include:\u00a0\u00a0<\/p>\n

- A\u00a0new \u201cearned progression model\u201d for prisoners serving standard determinate sentences that will see prisoners who\u00a0behave badly\u00a0spend\u00a0longer\u00a0behind bars.\u00a0<\/li>\n
- Tougher community punishments\u00a0such as\u00a0new powers\u00a0for judges to\u00a0bar criminals from pubs, concerts and sports matches, curtailing offenders\u2019 freedoms as punishment, financial penalties that force offenders to pay back for their crimes\u00a0or\u00a0unpaid work orders that force offenders to give back to society.\u00a0<\/li>\n
- New \u201crestriction zones\u201d\u00a0to\u00a0restrict offenders to a certain area, allowing victims to travel without fear of seeing them.\u202f\u00a0<\/li>\n
- A judicial finding of domestic abuse in sentencing which will allow criminal justice agencies to identify domestic abusers, ensure they are better\u00a0monitored, and the right measures are in place to protect victims.\u00a0<\/li>\n<\/ul>\n
