Following the lead of several major Hollywood studios, the Motion Picture Assn. has sent its own cease-and-desist letter to ByteDance, the company behind the controversial AI video generator Seedance 2.0.<\/p>\n
The trade association, which represents the interests of major film and TV studios, sent a notice to the Chinese company, reflecting its members\u2019 collective response to \u201cByteDance\u2019s pervasive copyright infringement.\u201d MPA argues that Seedance\u2019s unauthorized use of copyrighted materials is a \u201cfeature, not a bug.\u201d <\/p>\n
The letter, sent last Friday, marks the first time the MPA has forwarded a cease-and-desist to a major AI firm, and represents a further escalation of tensions between the entertainment industry and an AI company.<\/p>\n
As the new AI generator spawned fabricated finales for \u201cGame of Thrones\u201d and fictional brawls between Thanos and Superman, Disney, Paramount, Warner Bros., Netflix and Sony Pictures<\/a> all launched their own legal threats last week. In the cease-and-desist letters, Netflix called Seedance \u201ca high-speed privacy engine\u201d;Warner Bros. argued that ByteDance used their materials to train its AI model, citing \u201ca deliberate design choice\u201d; and Disney claimed that the usage was a \u201cvirtual smash-and-grab\u201d of their IP. <\/p>\n This backlash was first triggered by a viral AI video of Brad Pitt and Tom Cruise fighting<\/a>, a little over a week ago. Due to its realistic nature and unauthorized use of the actors\u2019 likenesses, both SAG-AFTRA and MPA were among the first to call out the platform.<\/p>\n \u201cIn a single day, the Chinese AI service Seedance 2.0 has engaged in unauthorized use of U.S. copyrighted works on a massive scale,\u201d Charles Rivkin, chief executive of the Motion Picture Assn., previously wrote in a statement. <\/a>\u201cBy launching a service that operates without meaningful safeguards against infringement, ByteDance is disregarding well-established copyright law that protects the rights of creators and underpins millions of American jobs.\u201d<\/p>\n Amid this legal flurry, ByteDance, the company that also oversees TikTok<\/a>, put out a statement to CNBC<\/a>, writing that it \u201crespects intellectual property rights\u201d and is \u201ctaking steps to strengthen current safeguards as we work to prevent the unauthorized use of intellectual property and likeness by users.\u201d <\/p>\n The MPA said in its letter that \u201cat this point we need far more than general statements.\u201d The association rejects ByteDance\u2019s characterization of the infringement as unauthorized use of intellectual property by its users.<\/p>\n \u201cRather, it is ByteDance itself that trained its model on the MPA Member Studios\u2019 works without their consent (a necessary first step toward its production of infringing output),\u201d the MPA said, adding that ByteDance \u201creleased its service without guardrails; and, by its own conduct, reproduced and distributed content that blatantly infringes the MPA Member Studios\u2019 copyrights.\u201d<\/p>\n Luke Arrigoni, CEO of Loti AI, a company specializing in likeness protection technology, said he isn\u2019t surprised the industry has reached a \u201cbreaking point.\u201d<\/p>\n \u201cWhat ByteDance did with Seedance 2.0 is a clear illustration of what happens when AI companies treat human creativity as raw material rather than protected work,\u201d said Arrigoni in a statement. \u201cThe MPA\u2019s action sends a clear message that the entertainment industry will not subsidize the AI industry\u2019s growth at the expense of its own rights.
