Weissbart<\/a> \u2014 the partner and co-chair of the tax, benefits, and private client practice group at Blank Rome \u2014 exclusively tells Page Six how the pop star could <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/pagesix.com\/2026\/03\/05\/celebrity-news\/britney-spears-arrested-for-dui\/\">face legal repercussions after her arrest<\/a> for driving under the influence this week.<\/p>\n<p>\u201cAlthough a DUI arrest could be a factor for the imposition of another conservatorship, by no means would a conviction on a DUI result in the imposition of a conservatorship,\u201d Weissbart says.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Britney Spears\u2019 DUI arrest likely won\u2019t land her under another conservatorship, according to attorney Sean R. Weissbart.  <span class=\"credit\">britneyspears\/Instagram<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>The Blank Rome partner spoke with Page Six after Spears was arrested Wednesday.  <span class=\"credit\">Clint Brewer Photography \/ BACKGRID<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>The courts would need to demonstrate that the \u201cToxic\u201d singer is \u201cincapable of managing her personal and financial affairs\u201d in order for another conservatorship to be put in place, the lawyer explains.<\/p>\n<p>\u201cLet\u2019s be clear, the penalty for DUI is not the imposition of a conservatorship,\u201d Weissbart stresses. \u201cIt could be probation, it could be a fine, it could be community service, it could potentially even be incarcerated for a sentence.<\/p>\n<p>\u201cBut it\u2019s not the imposition of a conservatorship, right? There would have to be a pattern that demonstrates that she\u2019s truly incapable, on a long-term basis, of managing her personal affairs,\u201d he says. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>\u201cLet\u2019s be clear, the penalty for DUI is not the imposition of a conservatorship,\u201d Weissbart have to be \u201ca pattern\u201d that proves she is unable to manage her personal affairs or finances. <span class=\"credit\">Instagram\/@britneyspears<\/span><\/figcaption><\/figure>\n<p>Weissbart notes that her DUI arrest is \u201can isolated incident.\u201d<\/p>\n<p>\u201cIf someone can prove that she is suffering from mental illness, that she can\u2019t part with drugs or alcohol, that she\u2019s addicted, that it\u2019s impacting her ability to manage her personal affairs on an ongoing basis, then that would be what the court would look for to impose a conservatorship on her,\u201d he says.<\/p>\n<p>However, Weissbart believes the courts would look for the \u201cleast restrictive means possible.\u201d <\/p>\n<p>\u201cWhen someone has a conservator, their freedom is completely, completely mitigated because this other individual is managing their financial and personal affairs,\u201d he says. \u201cAn isolated DUI, although that\u2019s awful, is not necessarily resulting in the imposition of a conservatorship.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>One would have to prove that she is suffering from mental illness or dealing with addiction.  <span class=\"credit\">Britney Spears\/Instagram<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Weissbart doesn\u2019t believe Britney\u2019s dad, Jamie, would ever be her conservator again if it came to another legal arrangement. <span class=\"credit\">Instagram\/@britneyspears<\/span><\/figcaption><\/figure>\n<p>There is also a very small likelihood that Spears\u2019 father, Jamie Spears, would be named her conservator again if evidence did point to the singer needing to be placed under the legal arrangements.<\/p>\n<p>The New York City-based legal eagle also points to how Britney\u2019s rep told Page Six that the Grammy-winning artist \u201cis going to take the right steps and comply with the law\u201d and hopefully get the help she needs.<\/p>\n<p>\u201cI believe there was a statement made by Britney\u2019s rep that she\u2019s looking to make everything right and get her life in order,\u201d Weissbart says. \u201cBut if for some reason someone was going to have a conservator imposed again, I think the court will look for the most mild, least restrictive means to start if that were on the table.\u201d<\/p>\n<p>Weissbart noted how his firm led a #FreeBritney social media campaign when Britney was
