{"id":2338761,"date":"2026-03-20T15:59:56","date_gmt":"2026-03-20T15:59:56","guid":{"rendered":"https:\/\/celebrity.land\/en\/?p=2338761"},"modified":"2026-03-20T15:59:56","modified_gmt":"2026-03-20T15:59:56","slug":"afroman-wins-victory-in-lemon-pound-cake-defamation-case","status":"publish","type":"post","link":"https:\/\/celebrity.land\/en\/afroman-wins-victory-in-lemon-pound-cake-defamation-case\/","title":{"rendered":"Afroman wins victory in \u2018Lemon Pound Cake\u2019 defamation case"},"content":{"rendered":"<p><\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwps0a7003t27qtefhofot5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The rapper Afroman did not defame seven sheriff\u2019s deputies or invade their privacy when he put out a series of catchy, flamboyantly insulting music videos about them after they raided his home in 2022, an Adams County, Ohio jury ruled on Wednesday.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vo000f3b6r6dpd5zb2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a three-day trial that pitted two very different notions of personal outrage against each other, Afroman, whose legal name is Joseph Foreman, successfully argued that he had a First Amendment right to mock the deputies, as public figures, and that the over-the-top lyrics of his viral songs could not reasonably be taken as literal statements of fact.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000g3b6rxizwxap2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Decked in an American flag-patterned suit and matching sunglasses, Afroman \u2014 best known, before the videos that brought him into court, for his 2000 hit \u201cBecause I Got High\u201d \u2014 turned the proceedings into a display of virality, using the witness stand as one more platform to present the raid as a serious act of wrongdoing, and to insist on his power to make fun of it.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000h3b6rmzd4kjnr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAfter they run around my house with guns and kick down my door,\u201d he said during the trial, \u201cI got the right to kick a can in my backyard, use my freedom of speech, turn my bad times into a good time.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000i3b6rqbta7o43@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In August 2022, a squad of deputies from the Adams County Sheriff\u2019s Office broke down his door with weapons in hand. He wasn\u2019t home at the time, but a family member recorded videos of the search on their phone, and footage from the house\u2019s security cameras shows the officers tearing through his kitchen.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000j3b6r1p9khkm2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The officers had a warrant to search for evidence for drug trafficking and kidnapping, according <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.wcpo.com\/news\/local-news\/afromans-defense-prepares-to-present-their-side-during-day-3-of-civil-trail\" target=\"_blank\">to celebrity.land news affiliate WCPO<\/a>, but they failed to find anything that would justify charges. By Afroman\u2019s account, the officers left his house torn apart, cut his security video cords, took cash from his home \u2014 officials later announced that deputies had merely miscounted the money \u2014 and traumatized his kids.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000k3b6rz7xh01xt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            So Afroman took his anger, and his case, to the internet, working to outmaneuver the deputies in the court of public opinion. After uploading the footage of the raid onto his Instagram page shortly after the incident, Afroman remixed it into multiple YouTube videos over the following months \u2014 even releasing an album titled \u201cLemon Pound Cake,\u201d after the moment in the footage in which an officer apparently did a double take <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.instagram.com\/p\/Chsg3JDjw_m\/?hl=en\" target=\"_blank\">at the cake<\/a> sitting on Afroman\u2019s kitchen island.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000l3b6rd12njmqd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe Adams County Sheriff kicked down my door \/ Then I heard the glass break \/ They found no kidnapping victims \/ Just some lemon pound cake,\u201d he croons in the title track. The music video, from 2022, has more than 3 million views on YouTube.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000m3b6rfl8di330@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Beyond criticizing the raid, the barrage of videos also attributed various personal, professional and sexual transgressions to the deputies. The deputies claimed that these were intentional lies that harmed their reputations and made their lives and their jobs more difficult. Deputy Lisa Phillips wept on the stand during a courtroom playing of the song and video \u201cLicc\u2019em Low Lisa,\u201d which fictitiously portrayed her having sex with multiple women.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000n3b6rv4l3jncl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Asked on the stand about Phillips being upset about the video, Afroman compared it to his own experience, saying she had been standing \u201cin front of my kids with an AR-15, with her hand around the trigger ready to shoot me.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000o3b6re7ast1kc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBut I\u2019m not a person. She is,\u201d he said. \u201cI\u2019m sorry for being a victim. Let\u2019s talk about the predators.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000p3b6rpcm3zksw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As the officers involved pursued legal action, bringing more attention to the videos, commenters on the videos rallied in support of Afroman.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000q3b6r86m6l4ip@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAfroman making the whole second half of his career off that raid,\u201d one said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000r3b6rfp5yi80r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWatch the videos and laugh your a** off but also pay attention to what\u2019s happening in court,\u201d another said. \u201cAfroman is standing up for all our rights right now.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000s3b6rzwl0spz6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Robert Klingler, the lawyer for the deputies, appealed to a different sense of shared values in his closing argument, telling the jury that \u201ca search warrant execution that you think was unfair\u2026doesn\u2019t justify telling intentional lies designed to hurt people.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000t3b6rw3wcjcuy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat\u2019s what decent people think,\u201d Klingler said. \u201cBut Mr. Foreman thinks it\u2019s okay to do what he\u2019s done over 3 1\/2 years because they executed a search warrant that broke down his door and disconnected his cameras.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000u3b6rxwrxjnqu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That was, in fact, the split between the worldviews of the two sides: Was it a bigger offense against one\u2019s privacy and dignity to have armed agents of the government physically burst into one\u2019s home and ransack it looking for nonexistent evidence of a crime, or to be laughed at by millions of people on the internet?\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000v3b6r1sc9vsi4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Afroman\u2019s lawyer, David Osborne Jr., argued in closing that one didn\u2019t even need to share the rapper\u2019s perspective to accept his right to vent his feelings in music and lyrics. \u201cLemon Pound Cake\u201d and the rest were commentary \u2014 just like N.W.A\u2019s \u201cF**k tha Police,\u201d Osborne said, citing that once-outrage-inducing track as part of the canon of accepted American self-expression.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000w3b6rgcxk8eb3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Afroman\u2019s more extreme lyrics, Osborne said, were like the lyrics to \u201cWAP\u201d by Cardi B and Megan Thee Stallion (\u201cCarly B\u201d and \u201cMegan Three Stallion,\u201d as Osborne put it). Earlier in the trial, the ex-wife of one of the deputies had testified that, as a schoolteacher, she had witnessed children playing that song and \u201cLemon Pound Cake\u201d and that in neither case had they taken the words for literal truth.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmwxq5vq000x3b6r2826ol3s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat\u2019s all entertainment,\u201d Osborne said. \u201cThey made fun of everybody for entertainment. And some of it is a social commentary, but it is not fact. And everybody knows that.
