Case in point, the singer\u2019s ongoing trademark war with real-life Las Vegas showgirl Maren Wade.<\/p>\n It\u2019s been an eventful few days for the dispute, with Wade requesting an immediate ban<\/a> on album-related merch sales and Swift<\/a>\u2019s lawyers arguing that doing so defied \u201ccommon sense\u201d and would trample Swift\u2019s right to free speech. That\u2019s why you can\u2019t get a preliminary injunction.\u201d<\/p>\n Not just that, she said that Wade would have to prove that consumers who engage with her shows, her podcast or her books are thinking, \u201cOh, that\u2019s Ms. Swift,\u201d or \u201cthat\u2019s a Swift-sponsored activity\u201d to be able to obtain \u201cthe extraordinary remedy she seeks.\u201d<\/p>\n \u201cI don\u2019t see how that could ever happen,\u201d he said. \u201cFor them to prevail, it\u2019s not realistic.\u201d<\/p>\n Wade filed a lawsuit against Swift for trademark infringement in March, with her lawyer arguing that Wade owns a federally registered trademark for \u201cConfessions of a Showgirl\u201d and that the U.S. Patent and Trademark Office \u201crefused\u201d Swift\u2019s application to register her album title because it was too similar.<\/p>\n \u201cSince 2014, that mark has identified one person. A search for it returned one person. Today, [Wade\u2019s] mark no longer points to [Wade.] \u00a0When a consumer types her exact registered mark into Google, autocomplete suggests [Swift],\u201d Wade\u2019s lawyer said. \u201cThat\u2019s reverse confusion,\u201d he continued. \u201c[Wade] owns the mark, and defendant\u2019s conduct is eroding it. Money cannot fix that.\u201d<\/p>\n Wade has asked for an emergency moratorium on merchandise sales while the case plays out, but a judge has not yet issued a ruling. Lawyers for Swift argued that Wade took advantage of the publicity generated by Swift\u2019s album when it was first released to draw attention to her brand.<\/p>\n All of this comes after speculation about what prenup Swift and her soon-to-be-husband, Travis Kelce<\/a>, could sign has started swirling. Swift\u2019s net worth is somewhere around $1.6 billion. Kelce\u2019s, meanwhile, is around $70 million.
