music licensing subsidiary <strong>Jamendo<\/strong> has filed a copyright lawsuit against generative AI music company <strong>Suno<\/strong>.<\/p>\n<p>The complaint, <a rel=\"nofollow\" target=\"_blank\" class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2026\/06\/Jamendo-vs-Suno.pdf\">which you can read in full here,<\/a>\u00a0was filed in a US federal court in <strong>Massachusetts<\/strong> on Monday (<strong>June 29<\/strong>) against <strong>Suno, Inc.<\/strong><\/p>\n<p>The lawsuit comes days after <strong>Jamendo<\/strong> <a rel=\"nofollow\" target=\"_blank\" class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/nvidia-hit-with-us-copyright-suit-claiming-it-trained-ai-models-on-winamp-subsidiary-jamendos-music-without-permission\/\" target=\"_blank\" rel=\"noopener\">sued chipmaker Nvidia<\/a> in the United States, and is the second copyright complaint the <strong>Winamp<\/strong> subsidiary has brought against an AI developer in under two weeks.<\/p>\n<p>The complaint relates to the alleged unauthorized use of musical content and associated data operated by <strong>Jamendo<\/strong> in the development and operation of AI technologies, <strong>Winamp Group<\/strong> said.<\/p>\n<p>It includes claims for copyright infringement, breach of contract and unjust enrichment, as well as unfair and deceptive business practices under <strong>Massachusetts<\/strong> law.<\/p>\n<p>The copyright claims are brought under the <strong>US Copyright Act<\/strong> and seek monetary damages and injunctive relief, according to the company.<\/p>\n<p>In the complaint, <strong>Jamendo<\/strong> says <strong>Suno<\/strong> \u201cblatantly disregarded\u201d its intellectual property rights by using its catalog and data to develop its AI platform \u201cwithout any authorization.\u201d<\/p>\n<p>The case centers on the <strong>MTG-Jamendo Dataset<\/strong>, a research collection of more than <strong>55,000<\/strong> tracks that <strong>Jamendo<\/strong> built from its catalog around <strong>2019<\/strong>.<\/p>\n<p>The <strong>US Copyright Office<\/strong> issued a registration for the dataset on <strong>June 17<\/strong>, according to the complaint.<\/p>\n<p>The complaint alleges that <strong>Suno<\/strong> used the dataset to train its AI, including an early open-source model called <strong>Bark<\/strong> that it says was built in part on roughly <strong>919<\/strong> hours of <strong>Jamendo<\/strong> audio.<\/p>\n<p><strong>Jamendo<\/strong> made the dataset available for non-commercial research only, and says any commercial use requires a paid license from the company.<\/p>\n<p><strong>Suno<\/strong>\u2018s use of the data to train a commercial AI system fell outside that grant and amounts to \u201cwillful\u201d copyright infringement, the complaint says.<\/p>\n<p>Citing <strong>Suno<\/strong>\u2018s own public statements, the complaint says the company \u201cembraces the view that \u2018impatience is a virtue&#8217;\u201d and emphasizes \u201cextreme speed\u201d in building its service.<\/p>\n<p><strong>Jamendo<\/strong> says it invoiced <strong>Suno<\/strong> for the unauthorized use on <strong>September 29<\/strong> last year, and that <strong>Suno<\/strong> confirmed receipt by <strong>October 3<\/strong> but did not pay.<\/p>\n<p><strong>Jamendo<\/strong>\u2018s Belgian counsel sent a formal notice of default on <strong>October 14<\/strong>, the complaint says. <strong>Jamendo<\/strong> is seeking an injunction, plus actual damages and <strong>Suno<\/strong>\u2018s profits of \u201cno less than\u201d <strong>\u20ac17.8 million<\/strong>, according to the complaint.<\/p>\n<p>In the alternative, it is seeking statutory damages of up to <strong>$30,000<\/strong> per infringed work, rising to <strong>$150,000<\/strong> per work where infringement is found to be willful.<\/p>\n<hr\/>\n<p>That <strong>Nvidia<\/strong> complaint was filed on <strong>June 22<\/strong> in the US District Court for the <strong>Northern District of California<\/strong>.<\/p>\n<p>It accuses the chipmaker of training two of its AI audio models, <strong>Fugatto<\/strong> and <strong>Audio Flamingo<\/strong>, on the same <strong>MTG-Jamendo Dataset<\/strong>.<\/p>\n<p><strong>Jamendo<\/strong> says the proceeding against <strong>Suno<\/strong> is separate from the <strong>Nvidia<\/strong> case, but that both raise similar issues over the alleged unauthorized use of its content to develop AI.<\/p>\n<p>The dispute with <strong>Nvidia<\/strong> has also reached a court in <strong>Belgium<\/strong>, where the <strong>Ghent Enterprise Court<\/strong> confirmed its jurisdiction in June over a related commercial claim of about <strong>\u20ac16 million<\/strong>.<\/p>\n<p><strong>Jamendo<\/strong> had <a rel=\"nofollow\" target=\"_blank\" class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/amid-plans-to-sue-nvidia-and-suno-music-platform-jamendo-launches-ai-powered-search\/\" target=\"_blank\" rel=\"noopener\">publicly threatened legal action<\/a> against both <strong>Nvidia<\/strong> and <strong>Suno<\/strong> in <strong>2025<\/strong>.<\/p>\n<p><strong>Jamendo<\/strong>\u2018s suit adds to the copyright litigation <strong>Suno<\/strong> already faces in the US and Europe.<\/p>\n<p><strong>Suno<\/strong> remains in litigation with <strong><a rel=\"nofollow\" target=\"_blank\" target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; Universal Music Group [4,747 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/universal-music-group\/\">Universal Music Group<\/a><\/strong> and <strong><a rel=\"nofollow\" target=\"_blank\" target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; Sony Music Entertainment [2,179 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/sony\/sony-music-group\/sony-music-entertainment\/\">Sony Music Entertainment<\/a><\/strong>, which are seeking to <a rel=\"nofollow\" target=\"_blank\" class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/umg-and-sony-seek-to-add-61000-copyrighted-works-to-suno-lawsuit-after-discovery-reveals-suno-trained-on-millions-of-their-recordings\/\" target=\"_blank\" rel=\"noopener\">add more than 61,000 recordings<\/a> to their case.<\/p>\n<p>That major-label case is being heard in the <strong>District of Massachusetts<\/strong>, the same federal district where <strong>Jamendo<\/strong> has now filed.<\/p>\n<p><strong>Suno<\/strong> also faces separate copyright suits from <a rel=\"nofollow\" target=\"_blank\" class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/suno-sued-again-as-danish-cmo-koda-accuses-company-of-stealing-its-members-music-to-train-ai-model\/\" target=\"_blank\" rel=\"noopener\">Denmark\u2019s Koda<\/a> and Germany\u2019s <strong><a rel=\"nofollow\" target=\"_blank\" target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; GEMA [161 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/gema\/\">GEMA<\/a><\/strong>.<\/p>\n<p><strong>Suno<\/strong> settled with <strong><a rel=\"nofollow\" target=\"_blank\" target=\"_blank\" class=\"link-relationship\" title=\"Companies &gt; Warner Music Group [3,695 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/access-industries\/warner-music-group\/\">Warner Music Group<\/a><\/strong> in <strong>November 2025<\/strong>.
