Harvey Weinstein is in the middle of his third trial for the alleged sexual assault of Jessica Mann, who has accused him of raping her in a Manhattan hotel room in March 2013
Jessica Mann has testified that she “passed out” while Harvey Weinstein allegedly assaulted her.
The now 40-year-old broke down sobbing on the witness stand on April 28 as she claimed that Weinstein held her down on a bed at the Doubletree Hotel in Midtown Manhattan and raped her on March 8, 2013. “I said, ‘No’ over and over, and I tried to leave,” she said.
Weinstein is currently embroiled in his third trial in Manhattan involving alleged sex crimes. He was originally convicted of raping Mann in 2020, but a higher court later overturned the verdict, which led to a second trial ending in a hung jury. The 74-year-old pled not guilty and denies any wrongdoing.

Mann also showed the jury how Weinstein allegedly pinned her wrists above her head during the assault. “He just treated me like he owned me,” she added.
She described another alleged rape that occurred later that year, claiming she passed out during that assault because he was “so heavy,” alluding to the producer’s then-300-pound weight. Mann said she first met Weinstein in Los Angeles at the age of 27 when she was starting her acting career.
Mann added that in February 2013, she had a “full-on breakdown” after the Hollywood producer allegedly tried to force her to have a threesome with himself and Italian actress Emanuela Postacchini at the Montage Beverly Hills hotel. She said that while he tried to coerce her, she ran into a bathroom and burst into tears.
While on the stand, Mann testified that at one point her relationship with Weinstein was consensual because she hoped it would lead to a “loving relationship” and because of his Hollywood star power. “Harvey told me a lot of stories about just how powerful he was and the things he did,” she said. “Essentially, his friends go very far and his enemies don’t step foot in this town.”
“He just always name-dropped everybody all the time,” she added. “It was just the part of the reality of who he is. He is not a normal person. I was not in a relationship with a normal person.”
Mann added that Weinstein claimed he was in an “open relationship” with his then-wife, Georgina Chapman, when Mann was in a consensual relationship with him.
Weinstein is still waiting to be sentenced for the conviction of the oral rape of Project Runway production assistant Mimi Haleym which he could face up to 25 years for. He was convicted of that charge in 2020, and it was also overturned by a New York high court alongside Mann’s charge. However, a second trial upheld his conviction involving Haley, though they could not reach a decision for Mann.
He was previously convicted of rape in California and was sentenced to 16 years.
