Christina Ricci‘s ex-husband James Heerdegen has been denied emergency custody of their son.
According to court documents obtained by PEOPLE, the Yellowjackets star’s ex-husband, 43, filed for an emergency custody hearing after his 11-year-old son Freddie texted him to say that Ricci drank alcohol on a June 16 flight to Canada.
In her response, Ricci stated that Freddie did contact Heerdegen and said that she’d consumed alcohol and used “certain words” to describe the manner in which his mom drank and later acted.

However, the documents stated that on June 18, attorneys for Freddie spoke directly with him about the incident. Freddie said that he’d “overreacted” in sending those text messages, that Ricci’s behavior was not as he’d described it, and that he had no fear being in her primary physical custody.
Ricci requested that documents containing the text messages between Freddie and his dad be sealed, citing bullying that her son had endured at his school. The actress suggested that if the documents were unsealed, Freddie might go through that experience again, which “may jeopardize” his mental health.
The court agreed and sealed the text messages. They also denied Heerdegen’s emergency custody order.
Reps for both Ricci and Heerdegen didn’t immediately respond to PEOPLE’s request for comment.
Ricci filed for divorce from Heerdegen in July 2020. The two married in 2013 after meeting on the set of Pan Am. Ricci married husband Mark Hampton in 2021.
In January 2021, the actress obtained a domestic violence restraining order against Heerdegen after she accused him of physical abuse, in court documents obtained by PEOPLE at the time. In her filing, Ricci claimed she was subjected to “severe physical and emotional abuse” by Heerdegen, with “many of these acts of abuse” taking place in front of their son.
A rep for Ricci did not immediately respond to PEOPLE’s request for comment at the time. That month, Heerdegen’s attorney Larry Bakman said in a statement obtained by PEOPLE that his client “unequivocally denies all allegations of abuse made by Ms. Ricci as having occurred in 2020.”
