Justin Baldoni’s legal team claims Blake Lively improvised an unscripted kiss in a scene from It Ends With Us which was cut from the final movie.
According to docs obtained by the Daily Express US, Justin’s team has filed a motion for summary judgment and submitted new evidence in Lively’s lawsuit against him. Newly emerged footage from the romantic drama, starring Blake as Lily Bloom, who moves to Boston to chase her dream of opening her own business, and Justin as neurosurgeon Ryle Kincaid, shows the actress, 38, bumping into the actor, 41, in the corridor of the hospital.
She then apologizes for the interruption and plants a brief kiss on his lips, casually telling him on the way out that she “happen[s] to love him too.”
Justin’s character looks on in surprise before tossing his phone and saying, “Alright, cut.”
The actor’s team has claimed in a new legal filing submitted by his Wayfarer production company on November 13 that the scene was not scripted and that Blake improvised the kiss.
The actor’s lawyers claim that Blake “oversaw” the scene, filmed in May 2023, that “she herself added to the script, in which her character kissed Baldoni’s character in every take, although there was no kiss in the script.”
The new filing comes after a New York judge dismissed Justin’s $400 million countersuit against Blake last week.
Judge Lewis Liman entered the ruling on October 31 after the star and his company missed an October 17 deadline to refile their case. The judge had dismissed the lawsuit in June, but left things open for Justin to refile.
When the actor and his company didn’t submit an amended complaint, the judge closed the case for good. The actress was the only party to respond, asking that the dismissal be made final while keeping her request for attorneys’ fees active, which was granted.
After the lawsuit was originally thrown out in June, Justin’s team released a statement that read, “The court decision on the motion to dismiss has no effect whatsoever on the truth that there was no harassment nor any smear campaign, and it does not in any way affect our vigorous defense against Ms. Lively’s claims.”
The actor previously filed the $400 million extortion and defamation lawsuit against Lively, her husband, Ryan Reynolds, and The New York Times.
He first filed the lawsuit in January 2025, a month after Blake claimed that on the set of the film It Ends With Us, he created a hostile work environment, participated in sexual harassment, and tried to create a smear campaign against her.
The star countersued, claiming it was an attempt to destroy his reputation. He included The New York Times as the publication ran a December 2024 article detailing Blake’s claims.
Meanwhile, attorneys for Blake have claimed she lost over $161 million in past and future wages due to her legal drama with jer fellow actor.
The nine-figure sum supposedly comes from a base of $56.2 million in past and future wages, including expected income from her roles as an actress, producer, public speaker, and pitch person.
According to documents obtained by Daily Express US, Blake’s lawyers noted that two of her businesses had been negatively impacted due to Justin’s alleged campaign against her.
It was reported that the Gossip Girl star’s beauty brand, Blake Brown, lost $49 million, with her legal team also estimating that Betty Buzz/Betty Booze, her drinks company, missed out on $22 million.
Blake’s attorneys further alleged that the supposed online smear campaign against her led to a loss of $34 million in monetary damage to her reputation.
They also said that there were 65 million negative impressions about her in connection with her legal drama. However, it has been noted that these estimates could change with further analysis from experts.
The Express US has reached out to representatives for both Justin Baldoni and Blake Lively for comment on the latest court filing.
